Supreme Court strikes down Gov. law against offensive trademarks

In an 8-0 ruling by the Supreme Court has stuck down a clause in the US Trademark law citing that the Federal Government cannot refuse to grant protections to trademarks that some consider offensive.

The clause cites that a Trademark cannot be granted on a mark that may disparage people or bring them into contempt or disgrace.

The overriding opinion is that the disparagement clause violates the First Amendment’s free speech clause. Trademarks are private, not government speech.

The Court sided with the group, “The Slants” an Asian-American musical group who applied for a Trademark in 2011 and was rejected citing the previously mentioned reason.

The decision is a victory of sorts for the group as the group’s name was an attempt to reverse the perception of a slur of an ethnic group and use the name as a badge of pride.

In Washington, DC there is now renewed optimism from NFL Redskin owner, Daniel Snyder whose Washington Redskins trademark was cancelled in June 2014.

With this ruling it could surely will bring on an avalanche of applications for trademarks of the most vile and offensive names for registration or will they??

Only time will tell, we’ll see….

Famed Comedian, Author and Educator Bill Cosby’s long awaited Sexual assault trial ended in a mistrial.

The accuser, Ms Andrea Constand claims Mr. Cosby sexually assaulted her in January of 2004 giving her drugs and sexually taking advantage of her.

One juror who did not vote to convict Cosby out it this way  “No stained garment, no smoking gun, nothing,” he said, adding that you could draw little from evidence from decades ago.

President Trump Fires FBI Director/Steve Harvey heads West Leaves.. his old staff behind

unnamedPresident Donald Trump fired FBI Director James Comey on May 9th.This was another astonishing, but not extraordinary action from this Administration. The initial reason was Trump, under the advisement of Jeff Sessions, Attorney General and Deputy Attorney General, Rod Rosenstein, who penned a memo “Restoring Public Confidence in the FBI” recommended his termination. Simply put, the President had no faith in now former FBI Director, James Comey.

His staff trumpeted the message through various news outlets. However on May 11th in an interview with NBC’s Lester Holt, he cited, “This Russia thing with Trump and the Russians moved him to make that decision to fire Director Comey and that he was going to do it regardless of the recommendation.

The firestorm of criticism was immediate with charges by his critics ranging from of “a poor choice” to “cover up” sent the Administration reeling. There have been more calls for an Independent Investigation from Democrats and now a few Republicans.

This looks like an issue that could dog this Administration with no signs of going away anytime soon.
